Yes, but only while using paper RODS logs and only for the period allowed by regulation (up to 8 days while awaiting ELD repair or replacement). The driver must note the malfunction on each paper log, the carrier must be notified within 24 hours, and the carrier must take action to repair or replace the ELD.
Each paper RODS must include the malfunction code or indicator reported by the ELD, in addition to the standard duty-status entries. Logs without the malfunction annotation may not satisfy the documentation requirement under 49 CFR 395.34 when reviewed at roadside or during a compliance review.
The RODS must conform to the 24-hour duty-status grid format specified in 49 CFR Part 395. A printed template that reproduces the required format may be acceptable — verify the specific format requirement with FMCSA and confirm the template meets the regulatory specification before relying on it during a malfunction.
